About this employee termination letter

Provide a factual separation record with the effective date, reviewed final-pay arrangements, benefits contacts, and handover steps.

When to use it

  • Use after the employer has reviewed and made a separation decision.
  • Use a separate severance draft for additional payment and any proposed release; a termination letter is not that negotiated agreement.

What to gather before completing it

  • Check the actual reasons, supporting records, prior communications, protected leave, accommodation, and retaliation concerns.
  • Reconcile unpaid wages, commissions, earned leave, expense payments, and the statutory final-pay timing.
  • Identify required separation and benefits documents and assign a contact for questions and property return.

Common mistakes to avoid

  • Calling an involuntary separation voluntary to change the pay deadline.
  • Conditioning earned wages on returning property or signing an unrelated release.
  • Including an unnecessary medical diagnosis or unverified allegation in the letter.

After you complete the document

  • Deliver the actual required notices and wages using the reviewed timing and method.
  • Document receipt and the equipment, access, and records handover.
  • Retain factual decision support and benefits correspondence separately from private medical records.

What the template includes

The online builder and downloaded documents use the same fields. A selected state can add relevant research prompts. Complete only applicable items; add explanations for exceptions rather than assuming a blank entry resolves them.

  • Download Word if you need to add an attachment or adjust the layout.
  • Keep the completed document and supporting records together.

Before signing or submitting

Employment, wage, leave, privacy, and separation requirements depend on location and circumstances. Verify the applicable rules and avoid including unnecessary medical or sensitive information.

RESEARCH & REQUIRED NEXT STEPS

Federal requirements to review

A release needs additional consideration and protected-rights exclusions

EEOC guidance distinguishes severance consideration from amounts already owed and explains knowing, voluntary waivers. Do not require release of future discrimination claims or bar filing an EEOC charge or participating in its proceedings. Separate unpaid wages, benefits, and proposed severance; have the actual release and its exclusions reviewed.

Exclude qualifying protected leave from attendance discipline

DOL explains that protected FMLA leave must not be counted against employees through negative attendance points or retaliation. Review employer coverage, employee eligibility, qualifying circumstances, and required notices before an attendance decision. A depleted PTO balance does not itself resolve whether the absence is protected.

Accommodation review can continue after ordinary leave ends

EEOC explains that unpaid leave or schedule changes can be reasonable accommodations, subject to the applicable coverage and undue-hardship analysis. Do not automatically terminate when an ordinary leave limit expires or demand a diagnosis in a public form. Record essential functions, the requested adjustment, discussion, and review outcome separately from medical records.
