Vehicle transfers & bills of sale

Use the endorsed title and required DMV documents. A bill of sale and a release-of-liability notice serve different purposes.

Coverage: Motor vehicles in the documented guidance. Boat, trailer, firearm, and other asset rules require their own review.

Complete title and tax paperwork

Report the change in ownership and update the title through DMV. Check whether REG 227, lienholder releases, use-tax documentation, or other transfer records are needed for your circumstances.

Seller: file the release notice

Submit the Notice of Transfer and Release of Liability within five calendar days of transfer and delivery. Record the buyer’s address, VIN or HIN, date, and mileage, and retain the confirmation. The NRL alone does not transfer ownership or remove your name from the title record.

California DMV — Notice of transfer and release of liability

Check smog and secure odometer documents

Confirm applicable smog certification or exemption and the proper odometer disclosure. REG 262 is a secure form obtained from DMV, not an ordinary printable replacement. Apply the federal model-year rule in the linked NHTSA guidance.

California DMV — Title transfers and changes

Use the correct supporting sale form

REG 135 is DMV’s printable bill of sale; it is separate from REG 138 and REG 262. A generated private agreement can record additional condition and payment terms while required DMV records still need completion.

Residential rental documents

A California lease needs deposit documentation, disclosure attachments, and a separate state and local rent-control and just-cause review.

Coverage: Residential rental research. Commercial, farm, hunting, equipment, and vehicle leases are separate subjects.

Deposit cap: check the small-landlord exception

For deposits collected from July 1, 2024, the general cap is one month’s rent. An exception may permit two months for qualifying small landlords, with additional restrictions. Record the owner’s legal status, property and unit counts, and exception eligibility before exceeding the general cap. The label “pet deposit” does not automatically remove a payment from security-deposit rules.

Photographs, inspection opportunity, and deposit accounting

Record move-in condition, the offered initial inspection, and repair or cleaning evidence. The current state guide describes photographs before and after work deducted from a deposit, and move-in photographs for new tenancies beginning July 1, 2025. The ordinary deposit accounting and refund period is 21 days after move-out; follow the specific rules for receipts and unfinished work.

2026 appliance and refund-method review

The 2026 guide explains digital deposit return when paid digitally unless the parties agree otherwise. It also describes stove and refrigerator habitability requirements with a tenant-supplied exception. Record payment method, appliance responsibility, and the reviewed exception; do not presume eligibility.

Known flood hazards need disclosure review

The guide describes disclosure when an owner actually knows the unit is in a flood hazard zone. Record the knowledge basis and written disclosure reference separately from insurance arrangements.

Rent limits and termination are separate decisions

Check whether the Tenant Protection Act applies and whether a city or county has stronger rent or eviction protections. Record building age, ownership, tenancy history, and any legally required exemption notice. Emergency price-gouging rules can also restrict rent increases. Do not presume a lease’s renewal clause authorizes a particular increase or no-cause termination.

Select and serve the right landlord notice

California Courts distinguishes pay-or-quit, cure-or-quit, and move-out notices. A notice must state the required information and be delivered correctly. Deadline counting differs between cure/payment notices and move-out notices. Our tenant-written notice-to-vacate is for a tenant’s move-out; the landlord notice-to-quit builder is only a review worksheet.

Use the official court process after notice

A pre-suit landlord notice and a court summons or complaint are different documents. Consult the courts’ landlord notice and service instructions before proceeding; use current judicial forms if an unlawful-detainer case is filed. A downloaded generic lease or worksheet is not a court-approved eviction packet.

Estate planning & official forms

California provides a statutory will and advance health care form. Distributed financial POA forms have important notice rules, and estate thresholds depend on procedure and death date.

Coverage: Wills, powers of attorney, estate and deed preparation where expressly documented. Research depth and document coverage vary.

Financial POA formalities

Probate Code 4121 requires a dated POA, proper signature, and acknowledgment or two eligible witnesses. Sections 4122 and 4128 address witness qualifications and required warnings for certain distributed forms.

The generic financial planning draft omits execution-ready California notice language. Review 4128 and the statutory form exception rather than treating a downloaded worksheet as sufficient.

Probate Code 6110 describes two witnesses present together for signing or acknowledgment who understand it is the testator’s will. Follow the complete rule and consider witness conflicts under 6112.

California Courts links an official statutory will for suitable circumstances. Its instructions warn against changing prescribed words; compare its limits with your needs before choosing it.

Small-estate thresholds change

Verify the correct death-date-specific threshold and procedure. Ventura Superior Court’s affidavit identifies $208,850 for deaths on or after April 1, 2025; other property procedures have different limits.
