About this vehicle bill of sale

Build a detailed record of a private vehicle transaction: who is selling, which vehicle is involved, what is being paid, what is known about condition, and what will be delivered. The bill of sale supports the transaction; title ownership, official mileage certification, tax and registration are separate procedures.

When to use it

  • Use it to record a private sale and retain matching copies for buyer and seller. Select the transaction stage so a pending payment or future delivery is not presented as a completed exchange.
  • For a gift or trade, describe the actual consideration and relationship. Use the appropriate state tax affidavit or gift process where required; a gift label does not establish exemption.
  • For installment payments, an unresolved lien, an estate seller, a missing title or salvage history, document the facts and complete the additional agreement or agency process needed for that case.

What to gather before completing it

  • Compare the seller’s identity and signing authority with the ownership documents. Check the VIN on the vehicle against the title, and inspect the title’s co-owner wording, lien information and brands.
  • Read the odometer directly. Record the unit and certification status, then obtain the required signed title or approved disclosure document. Do not rely on an old ten-year exemption statement for a 2011-or-newer model.
  • Agree on inspection, defects, price, cleared payment, keys, accessories, title delivery and handover time. Check both the title-issuing state and the buyer’s registration state before meeting to sign.

Common mistakes to avoid

  • Using the bill of sale instead of a required original title, official electronic-title form, odometer disclosure or DMV application.
  • Writing paid in full when a deposit is the only money received; omitting a lien because a payoff is planned; or leaving the buyer name blank on the title.
  • Treating as-is as permission to conceal known defects or ignore non-waivable rights. Keep specific repair promises and actual written warranty terms attached.

After you complete the document

  • Each party keeps the signed agreement, title-assignment copy, payment evidence and listed attachments. Record the actual keys, documents and items handed over.
  • The buyer completes the title, tax, insurance and registration requirements. The seller separately files the state notice of sale or release where applicable and retains confirmation.
  • Follow the applicable plate rule and arrange lawful transportation. A sale record by itself is not a registration, temporary tag or authorization to drive an unregistered vehicle.

What the template includes

The online builder and downloaded documents use the same fields. A selected state can add relevant research prompts. Complete only applicable items; add explanations for exceptions rather than assuming a blank entry resolves them.

Distinguish the agreed transaction from an already completed exchange. Agency filing and tax eligibility must be checked separately.

  • Transaction type

  • Intended registration state
  • County where sale occurs
  • Sale time and time zone
  • Actual or planned handover date
  • Handover time and time zone
  • Property exchanged and agreed value
  • Gift relationship and no-consideration details
Title, ownership & authority9 inputs +

Record the ownership documents you actually inspected. These entries do not replace an assigned title, lien release, or agency application.

  • Title issuing state
  • Ownership document status
  • Ownership documents inspected
  • Owner names exactly as on the title
  • Additional owner names and addresses
  • How owner names are connected
  • Title brands and vehicle-history flags
  • Seller signing capacity
  • Evidence of signing authority
Mileage & disclosure records7 inputs +

Record what the odometer shows and which official disclosure document is being used. A builder entry is not an approved secure odometer form.

  • Vehicle body type
  • Odometer display unit
  • Mileage observation date
  • Basis for mileage certification or exemption
  • Official title or odometer disclosure document reference
  • Buyer mileage review status
  • Mileage discrepancy and replacement odometer history
Liens, payoff & title delivery9 inputs +

Identify unresolved claims and the evidence of release. A promise to pay a lender is different from a completed lien release.

  • Recorded lien review status
  • Lienholder legal name and contact
  • Agreed payoff amount (USD)
  • Party receiving payoff funds
  • Planned or completed payoff date
  • Lien release status
  • Lien release issuer, date and reference

  • Inspector name, organization and contact
  • Inspection date
  • Inspection report reference and findings

  • Additional agreed payment dates and amounts

California NRL, smog & secure disclosure record5 inputs +

The release notice is separate from ownership transfer. Record the DMV requirements and official documents actually used.

  • NRL filing date and confirmation
  • Required smog certification or exemption evidence
  • Official secure REG 262 reference if needed
  • REG 227 replacement or transfer application reference if used
  • Buyer DMV title-transfer submission reference

Practical tips

  • Be specific. A clear description is easier to verify than a broad label.
  • Download Word if you need to add an attachment or adjust the layout.
  • Keep the completed document and supporting records together.

Before signing or submitting

This bill of sale does not replace a required title, registration, tax, or odometer disclosure form. Check the relevant state agency before transfer.

RESEARCH & REQUIRED NEXT STEPS

California requirements to review

Complete title and tax paperwork

Report the change in ownership and update the title through DMV. Check whether REG 227, lienholder releases, use-tax documentation, or other transfer records are needed for your circumstances.

Seller: file the release notice

Submit the Notice of Transfer and Release of Liability within five calendar days of transfer and delivery. Record the buyer’s address, VIN or HIN, date, and mileage, and retain the confirmation. The NRL alone does not transfer ownership or remove your name from the title record.

Check smog and secure odometer documents

Confirm applicable smog certification or exemption and the proper odometer disclosure. REG 262 is a secure form obtained from DMV, not an ordinary printable replacement. Apply the federal model-year rule in the linked NHTSA guidance.

Use the correct supporting sale form

REG 135 is DMV’s printable bill of sale; it is separate from REG 138 and REG 262. A generated private agreement can record additional condition and payment terms while required DMV records still need completion.

Federal odometer disclosure: use the model year, not a blanket ten-year exemption

NHTSA says model year 2011 and newer vehicles remain subject to odometer disclosure for their first 20 years; model year 2010 and older retain the previous age exemption. Complete the required signed title or approved secure odometer document and the mileage-status certification. Mileage entered in a private bill of sale does not automatically satisfy the agency’s disclosure format. Other vehicle-class exemptions can apply; verify the classification and never guess the reading.
