About this residential lease agreement

Turn the actual rental arrangement into a signed record of the premises, payments, responsibilities, and required attachments. The strongest lease package includes the condition evidence and disclosures delivered with it.

When to use it

  • Use for a residential tenancy with identified landlord and tenant parties and a defined rent arrangement.
  • Choose a room, short-stay, or commercial form when the occupancy and responsibilities differ from a standard home tenancy.

What to gather before completing it

  • Collect legal names, ownership or management authority, the complete address, unit boundaries, adult tenants, and authorized occupants.
  • Reconcile rent, proration, each refundable deposit, other charges, utility allocation, due dates, and payment instructions against a written schedule.
  • Check building age, local rent regulation, housing program coverage, disclosure attachments, and move-in condition photographs before signing.

Common mistakes to avoid

  • Using one “other fees” line for deposits, pet charges, advance rent, and nonrefundable charges without reviewing each category.
  • Treating a selected state, an exemption checkbox, or a lead acknowledgment field as proof that all legal requirements have been met.
  • Giving the landlord unlimited entry rights or omitting where repair requests and formal notices should be delivered.

This general lease is not a state-approved form. Deposit limits, late fees, entry rights, disclosures, rent control, and termination notices differ by location. Housing built before 1978 may require lead disclosures and a federal pamphlet. Verify local requirements before signing.

Permitted move-in charges are tightly limited

The AG lists first month’s rent, last month’s rent, a deposit up to one month’s rent, and actual lock-and-key costs as permitted upfront charges. Landlords may not require upfront application, pet, or broker fees. Screen every proposed charge separately; do not re-label a prohibited charge as an administrative deposit.

Security deposit banking, interest, and return

A deposit must be held separately in an interest-bearing Massachusetts bank account. Provide the required bank information and receipts, address annual interest, and follow the permitted-deduction process. The state guidance gives a 30-day post-termination return period. Last month’s rent is a different prepayment with its own interest requirements; do not combine it into one generic “deposit” balance.

Create the condition statement and track exclusions

The Housing Court guidance describes the signed condition statement and the statutory exclusions for some short-duration and vacation tenancies. Record existing damage and code defects, the delivery date, tenant response, and deposit receipt. Confirm coverage before applying the standard deposit workflow to a short stay.

Broker fees depend on who engaged the broker

Current state guidance distinguishes a tenant’s own retained broker from a broker engaged to serve a landlord. Keep the engagement contract and identify the party that hired the broker; do not automatically pass the landlord’s brokerage cost to the applicant.

Tenant notice and landlord nonpayment notice are different

For monthly tenancy-at-will, the AG describes notice at least 30 days or one month before the next rent due date, whichever is longer. A landlord’s nonpayment notice has a separate analysis, including cure rights and assisted-housing rules. A requested calendar date alone does not establish valid termination.

Pre-1978 housing: complete the disclosure package before signing

For covered housing built before 1978, give the EPA lead pamphlet, disclose known lead hazards and available reports, and attach the required warning and signed acknowledgments. A generic lease checkbox does not supply these materials. EPA lists conditional exceptions, including certain short stays without renewal rights; record the basis for any exception. Keep signed disclosures for three years.

Assistance animals require a separate accommodation review

Do not automatically apply pet deposits, pet fees, breed restrictions, or a no-pets rule to an assistance-animal request. HUD describes reasonable accommodations and when reliable disability-related information may be requested. Use a separate accommodation record, avoid collecting a diagnosis in a public template, and evaluate the specific request rather than assuming every animal is a pet.

Fair housing review applies to advertising and lease rules

Review screening criteria, occupancy provisions, advertisements, and house rules under federal fair housing protections and any broader state or local protections. Do not use protected characteristics as selection criteria. Identify reasonable accommodation and modification procedures separately from ordinary maintenance and rule enforcement.

Military termination rights need their own workflow

Do not make ordinary early-termination fees the only exit route. The SCRA can permit qualifying servicemembers to end a residential lease following qualifying service orders and required notice. Collect the notice, delivery evidence, qualifying orders or permitted documentation, and reviewed effective date through an appropriate private process.
