Practical tips

  • A financial POA does not substitute for a health care directive.
  • Florida generally restricts new springing financial POAs; do not select a future incapacity trigger without review.
  • California distributed durable POA forms can require statutory warnings under Probate Code 4128; this planning draft omits execution language.

Before signing or submitting

This is a planning and attorney-review draft, not an execution-ready statutory form. It has not been reviewed by a lawyer. State law can require particular wording, notices, witnesses, notarization, capacity, disclosures, or court procedures. Use the linked official form when appropriate and obtain jurisdiction-specific review before signing.

New Jersey requirements to review

Financial POA acknowledgment

N.J.S.A. 46:2B-8.9 requires a written instrument, proper signature, and acknowledgment under 46:14-2.1. Do not apply the health care directive witness rule to a financial instrument.

New Jersey Legislature — P.L.2000 c.109, financial POA formalities

Durability must be intentional

Section 46:2B-8.2 describes durability language, including continued authority despite incapacity or a stated incapacity trigger. Do not assume every authorization letter is durable. The linked enacted law contains this provision; verify later amendments before preparing the final instrument.
