About this month-to-month lease agreement

Document a recurring residential tenancy while preserving a clear rent-paying period, payment obligations, and reviewed procedures for later changes or termination.

  • Assuming “month-to-month” means either party can terminate immediately or without a lawful reason.
  • Using a generic 30-day interval without checking period alignment, contractual terms, or housing protections.

This general lease is not a state-approved form. Deposit limits, late fees, entry rights, disclosures, rent control, and termination notices differ by location. Housing built before 1978 may require lead disclosures and a federal pamphlet. Verify local requirements before signing.

Florida requirements to review

Deposit handling and settlement are different steps

Section 83.49 distinguishes permitted deposit holding methods, initial disclosure requirements, and move-out settlement. With no claim, return is due within 15 days after tenancy termination. A claim requires notice within 30 days; the tenant has 15 days after receipt to object. Some initial-disclosure and housing-category exceptions apply. Record the forwarding address, holding method, claim reasons, and notice evidence.

Email requires the statutory agreement

Do not assume a contact email authorizes legal notice. Section 83.505 sets out voluntary electronic-delivery agreement requirements and procedures. Keep that agreement, designated addresses, changes or revocations, and delivery records. Section 83.49 expressly permits a deposit claim by email only when the statutory conditions are met.

Monthly move-out: align notice with the rental period

For a tenancy without a specific duration, §83.57 requires at least 30 days’ notice before the end of a monthly period. This concerns termination by either party, not the separate nonpayment demand. Record the rental-period ending date and actual delivery date; older 15-day monthly summaries should not be used.

A one-year or longer lease needs a separate flood document

Section 83.512 requires a separate flood disclosure at or before execution of a residential rental agreement with a term of one year or longer. Use the statutory form and complete the landlord’s knowledge and assistance-history questions. A general insurance field or a sentence inside the lease does not substitute for that separate document.

Specify access without creating unlimited entry rights

Review §83.53 when setting maintenance, inspection, emergency, and showing access. Record the proposed notice procedure and permitted reasons for entry. Neither a possession of keys nor a broad lease sentence removes statutory access restrictions.

Pre-1978 housing: complete the disclosure package before signing

For covered housing built before 1978, give the EPA lead pamphlet, disclose known lead hazards and available reports, and attach the required warning and signed acknowledgments. A generic lease checkbox does not supply these materials. EPA lists conditional exceptions, including certain short stays without renewal rights; record the basis for any exception. Keep signed disclosures for three years.

Assistance animals require a separate accommodation review

Do not automatically apply pet deposits, pet fees, breed restrictions, or a no-pets rule to an assistance-animal request. HUD describes reasonable accommodations and when reliable disability-related information may be requested. Use a separate accommodation record, avoid collecting a diagnosis in a public template, and evaluate the specific request rather than assuming every animal is a pet.

Fair housing review applies to advertising and lease rules

Review screening criteria, occupancy provisions, advertisements, and house rules under federal fair housing protections and any broader state or local protections. Do not use protected characteristics as selection criteria. Identify reasonable accommodation and modification procedures separately from ordinary maintenance and rule enforcement.

Military termination rights need their own workflow

Do not make ordinary early-termination fees the only exit route. The SCRA can permit qualifying servicemembers to end a residential lease following qualifying service orders and required notice. Collect the notice, delivery evidence, qualifying orders or permitted documentation, and reviewed effective date through an appropriate private process.
