About this vehicle bill of sale

Build a detailed record of a private vehicle transaction: who is selling, which vehicle is involved, what is being paid, what is known about condition, and what will be delivered. The bill of sale supports the transaction; title ownership, official mileage certification, tax and registration are separate procedures.

When to use it

  • Use it to record a private sale and retain matching copies for buyer and seller. Select the transaction stage so a pending payment or future delivery is not presented as a completed exchange.
  • For a gift or trade, describe the actual consideration and relationship. Use the appropriate state tax affidavit or gift process where required; a gift label does not establish exemption.
  • For installment payments, an unresolved lien, an estate seller, a missing title or salvage history, document the facts and complete the additional agreement or agency process needed for that case.

What to gather before completing it

  • Compare the seller’s identity and signing authority with the ownership documents. Check the VIN on the vehicle against the title, and inspect the title’s co-owner wording, lien information and brands.
  • Read the odometer directly. Record the unit and certification status, then obtain the required signed title or approved disclosure document. Do not rely on an old ten-year exemption statement for a 2011-or-newer model.
  • Agree on inspection, defects, price, cleared payment, keys, accessories, title delivery and handover time. Check both the title-issuing state and the buyer’s registration state before meeting to sign.

Common mistakes to avoid

  • Using the bill of sale instead of a required original title, official electronic-title form, odometer disclosure or DMV application.
  • Writing paid in full when a deposit is the only money received; omitting a lien because a payoff is planned; or leaving the buyer name blank on the title.
  • Treating as-is as permission to conceal known defects or ignore non-waivable rights. Keep specific repair promises and actual written warranty terms attached.

After you complete the document

  • Each party keeps the signed agreement, title-assignment copy, payment evidence and listed attachments. Record the actual keys, documents and items handed over.
  • The buyer completes the title, tax, insurance and registration requirements. The seller separately files the state notice of sale or release where applicable and retains confirmation.
  • Follow the applicable plate rule and arrange lawful transportation. A sale record by itself is not a registration, temporary tag or authorization to drive an unregistered vehicle.

Use a notarized sale record when title data is incomplete

OMV requires the notarized bill of sale or invoice with the full vehicle description if the title assignment does not reflect the sale date, price, and buyer/seller signatures. Complete the ownership transfer documents as well.

Check an out-of-state notarization exception

OMV describes additional evidence when neither an out-of-state title assignment nor bill of sale was notarized, including the seller’s out-of-state ID or a qualifying affidavit. Confirm the applicable procedure before relying on this exception.

Estate transfers need separate authority

Identify the succession or heirship route and obtain the required supporting records. A private sale agreement cannot establish an heir’s authority. The Louisiana checklist may require a notarized act of sale or donation from the heirs, title assignment, and lien satisfaction.

Complete state and parish tax steps

Use the applicant’s domicile to confirm the applicable tax treatment with OMV. Report the vehicle transfer through the state’s notice service and retain proof; the sale document is not the notice.

Federal odometer disclosure: use the model year, not a blanket ten-year exemption

NHTSA says model year 2011 and newer vehicles remain subject to odometer disclosure for their first 20 years; model year 2010 and older retain the previous age exemption. Complete the required signed title or approved secure odometer document and the mileage-status certification. Mileage entered in a private bill of sale does not automatically satisfy the agency’s disclosure format. Other vehicle-class exemptions can apply; verify the classification and never guess the reading.
